Three organizations (Alliance for the Wild Rockies, Idaho Sporting Congress, and Native Ecosystems Council) challenged the Record of Decision for the Lost Creek-Boulder Creek Project in a complaint filed with Federal Court one year ago.The District Court issued an order this week that denies the Plaintiff's Motion for a temporary restraining order (TRO). This intermediate Court Order allows
the Payette National Forest to award a stewardship contract that will initiate restoration actions within a portion of the 50,000 acre project area. The project was designed with the support of the Payette Forest Coalition.
The Court Order denying the TRO is "not a final decision on the merits of the substantive issues presented in this case". However, combined with an earlier Court Order this
month granting intervenor status to the Payette Forest Coalition and Adams County, the judge acknowledged the role of collaboration. The Order states that "the public has an interest in supporting the collaborative process that was used in this case to develop the project".
The Court documents filed to date are available in the Payette Forest Coalition library for the LCBC project, filed under the tab labeled
"NEPA".
